Ontario Probation Period Rules 2026: Pay, Termination and Employee Rights

Ontario employee reviewing probation-period rules with an employer

Quick answer: Ontario’s Employment Standards Act (ESA) does not create a universal “probation period.” An employer may include probation in an employment contract, but the employee is still protected by minimum wage, overtime, vacation pay, leaves and other applicable standards from the start of employment. The three-month mark matters mainly because most employees become entitled to ESA termination notice or termination pay after three months of continuous employment.

This guide provides general information, not legal advice. Employment contracts and common-law rights can change the result.

Is there an automatic probation period in Ontario?

No. A probation period normally comes from an employment offer, written contract or workplace policy. Common lengths are three or six months, but calling someone “probationary” does not remove statutory employment rights.

If the contract contains no probation clause, an employer should not assume that a probation period automatically applies. Even when a valid clause exists, the employer must act honestly and comply with the ESA, the Human Rights Code and any stronger contractual obligations.

What rights do probationary employees have?

  • At least the applicable Ontario minimum wage
  • Overtime pay when the ESA rules apply
  • Vacation pay and public-holiday rights when eligible
  • Required eating periods and hours-of-work protections
  • Protection from discrimination and workplace reprisals
  • Access to ESA leaves after the relevant eligibility period

A probationary label cannot be used to avoid these minimum standards.

Can an employer terminate you during probation?

An employer can end employment during probation, but the reason cannot be discriminatory, retaliatory or otherwise unlawful. Under the ESA, an employee with less than three months of continuous employment generally is not entitled to statutory termination notice or termination pay. However, an employment contract, collective agreement or common law may provide additional rights.

After three months, most covered employees qualify for minimum notice or termination pay unless a specific ESA exception applies. See our Ontario termination pay guide for the notice chart and examples.

Does a six-month probation clause remove termination pay?

Not automatically. A contract may describe probation as six months, but it cannot provide less than the ESA minimum. Once an employee completes three months of continuous employment, statutory termination-notice rules may apply even if the employer’s internal probation period continues.

Can probation be extended?

An employer may propose an extension if the contract or policy permits it, but the extension should be documented clearly. It does not reset the employee’s length of service or erase ESA entitlements already earned. Ask for the new end date, performance expectations and review process in writing.

Practical checklist for employees

  1. Read the probation clause before accepting the offer.
  2. Confirm its length, evaluation criteria and benefits start date.
  3. Save the offer letter, policy and performance feedback.
  4. Ask for specific examples if performance concerns are raised.
  5. Check your final pay statement if employment ends.
  6. Get legal advice when the contract is unclear or the termination may involve discrimination or reprisal.

Probation-period example

Priya begins an Ontario job on January 8 under a written six-month probation clause. The employer ends her employment on May 20. Because she completed more than three months of continuous employment, the employer cannot rely only on the “six-month probation” label to ignore ESA termination requirements. The contract and circumstances still need to be reviewed.

Frequently asked questions

Do probationary employees receive vacation pay?

Yes. Vacation pay is an employment standard and generally begins accumulating from the start of employment. Read our Ontario vacation pay guide.

Can I be fired without a reason during probation?

An employer may terminate employment without alleging misconduct, but it must still meet applicable legal obligations. It cannot terminate for a prohibited discriminatory reason or punish an employee for exercising an ESA right.

Can I quit during probation?

Yes, but review your contract for a notice clause and consider giving reasonable written notice when possible.
